+# API TERMS OF SERVICE: JiRack 236B & SWA TECHNOLOGY  
+
+**Effective Date:** December 22, 2025

+## 1. INTELLECTUAL PROPERTY & OWNERSHIP  
+Users acknowledge that the JiRack 236B architecture, including the SwiGLU-Attention (SWA) Fusion kernels and Buffered Routing Embedding (BRE), are the exclusive proprietary technology of the Licensor.  
+
+- **No Transfer of Rights:** Access to the API does not grant any ownership interest in the model weights, architecture, or underlying code.  
+- **Signature Integrity:** Users are strictly prohibited from attempting to strip, obfuscate, or modify the embedded `proof_of_authorship` digital signature.

+## 2. THE "NO-PATENTING" COVENANT  
+By using this API, the User and its affiliates agree to a **Permanent Patent Standstill**:  
+
+- **Prohibition:** Users shall not file, or assist any third party in filing, any patent applications globally that disclose or claim the SWA Fusion logic, the BRE routing system, or any derivative architectural modifications discovered through the use of this API.  
+- **Penalty:** Any breach of this clause results in the immediate and automatic transfer of such patent rights to Konstantin Vladimirovich Grabko, plus liquidated damages.

+## 3. COMMERCIAL ROYALTY & THE "5% RULE"  
+For users integrating JiRack 236B into a revenue-generating product (SaaS, Apps, Enterprise Tools):  
+
+- **Remittance:** A mandatory 5% Net Revenue Royalty is due to CMS Manhattan on all income derived from products powered by JiRack.  
+- **Reporting:** Commercial users must provide quarterly usage and revenue reports.  
+- **Exemption:** This royalty is waived for non-commercial research or hobbyist use (defined as **<$5,000 USD** total revenue per annum).

+## 4. REVERSE ENGINEERING & ATTACK PROHIBITION  
+Users are strictly prohibited from:  
+
+- **Model Distillation:** Using API outputs to train "copycat" models that mimic the JiRack 108-layer behavior.  
+- **Weight Extraction:** Using side-channel or prompt-injection attacks to reconstruct the proprietary tensor distributions.  
+- **Benchmarking:** Publishing comparative benchmarks without explicit written consent, ensuring "fair-use" optimization of SWA kernels is respected.

+## 5. DIGITAL SIGNATURE & ACCEPTANCE  
+Usage of the API keys provided constitutes a **Qualified Electronic Signature** under the ESIGN Act and eIDAS Regulation.  
+- The API's **"First Token Request"** serves as the cryptographic verification of your intent to be bound by these terms.
