+The complete tender in pdf format can be downloaded from the Graphic Era (Deemed to be) University website www.geu.ac.in. Following documents are required to be submitted along with bids.

+i. The tender fee of Rs. 590/- (Rupees five hundred ninety only) in the form of Demand Draft in favour of the Graphic Era (Deemed to be) University payable at Dehradun from any Commercial/ Recognized/ Nationalized Bank in India.

+ii. The Bidders are required to submit Tender Fee, EMD Amounting to Rs. 1,00,000/- (Rupees One Lakh only) with Technical Bid of the tender document along with a copy of all certificates as may be required. These documents shall be sent to and received physically by the Office of Registrar, Graphic Era Deemed to be University, Dehradun, Uttarakhand by hand or by post before the last date of submission of Tender Document.

+Inspire a component of " Scheme for Early Attraction of Talents for Science (SEATS)" under the INSPIRE Program is the enrolment increasing phase. In this component of SEATS, student would be selected for summer winter camps on an annual basis to provide an opportunity for students to interact with global Leaders in Science to experience the joy of innovations on an annual basis through INSPIRE internship. Annually 50,000 students who are among top one percent in their X Board Examination and pursuing science in standard XI would be benefited through summer /winter camp. These camps would nourish the curiosity of children in sciences; help them to think out of the box and attract the students at an early age of 16-17 years (i.e. in XI standard) to pursue a research career.

+The complete tender in pdf format can be downloaded from the Graphic Era (Deemed to be) University website www.geu.ac.in. Following documents are required to be submitted along with bids.
+
+i. The tender fee of Rs. 590/- (Rupees five hundred ninety only) in the form of Demand Draft in favour of the Graphic Era (Deemed to be) University payable at Dehradun from any Commercial/ Recognized/ Nationalized Bank in India.
+
+ii. The Bidders are required to submit Tender Fee, EMD Amounting to Rs. 1,00,000/- (Rupees One Lakh only) with Technical Bid of the tender document along with a copy of all certificates as may be required. These documents shall be sent to and received physically by the Office of Registrar, Graphic Era Deemed to be University, Dehradun, Uttarakhand by hand or by post before the last date of submission of Tender Document.

+The Technical Bid and Financial Bid are to be submitted in a separate sealed envelope and both the sealed envelope should be kept in a third envelope superscribing “Tender for Procurement of Equipment for Fourier transform infrared (FTIR) spectroscopy Graphic Era (Deemed to be) University. Financial offers should not be attached with the Technical Bid. In case, financial offer is found with the technical bid, the offer will be summarily rejected.

+27. Repeat Clause: The University may procure the equipment on repeat order basis on the same cost, terms and conditions within a period of six months from the date of its original supply order.

+Inspection: The inspection of the equipment will be carried out by the University’s Purchase Committee in the premises of the manufacturer to ensure the quality of the material/equipment, before the supply is made by the agency. On receipt of the equipment, inspection will be carried out by the Committee of the University. In case it is found that the equipment ordered are not meeting the requirement and not found to be conforming to the laid down specifications and are defective, the same shall not be accepted by the University and EMD submitted by the agency will be forfeited.

+29. Delivery of equipment will be subjected to the acceptance, testing of the equipment after its installation/commissioning.
+
+30. Security Deposite: The agency will be required to give performance Security Deposit of sum of 10% of the value of the equipment in the form of F.D.R/Bank Guarantee of a Nationalized Bank payable in favour of Graphic Era (Deemed to be) University, Dehradun, Uttarakhand immediately after the supply and installation of the equipment. The Performance Security will be valid for total period of warranty obligations. The Bank Guarantee will be return on successful completion of warranty obligations.

+26. Option Clause: The University can exercise an option to procure an additional or less quantity in accordance with the same terms and conditions as given in this tender document.

+27. Repeat Clause: The University may procure the equipment on repeat order basis on the same cost, terms and conditions within a period of six months from the date of its original supply order.

+Inspection: The inspection of the equipment will be carried out by the University’s Purchase Committee in the premises of the manufacturer to ensure the quality of the material/equipment, before the supply is made by the agency. On receipt of the equipment, inspection will be carried out by the Committee of the University. In case it is found that the equipment ordered are not meeting the requirement and not found to be conforming to the laid down specifications and are defective, the same shall not be accepted by the University and EMD submitted by the agency will be forfeited.

+29. Delivery of equipment will be subjected to the acceptance, testing of the equipment after its installation/commissioning.
+
+30. Security Deposite: The agency will be required to give performance Security Deposit of sum of 10% of the value of the equipment in the form of F.D.R/Bank Guarantee of a Nationalized Bank payable in favour of Graphic Era (Deemed to be) University, Dehradun, Uttarakhand immediately after the supply and installation of the equipment. The Performance Security will be valid for total period of warranty obligations. The Bank Guarantee will be return on successful completion of warranty obligations.

+However, the agency/firm shall not be liable for forfeiture of its performance security, liquidated damages or termination for default, if and to the extent that, it’s delay in performance or other failure to perform its obligations under the Contract is the result of an event of Force Majeure.

+For purposes of this Clause, "Force Majeure" means an event beyond the control of the Supplier and not involving the Supplier's fault or negligence and not foreseeable. Such events may include, but are not limited to, acts of the University either in its sovereign or contractual capacity, wars or revolutions, fires, floods, epidemics, quarantine restrictions and freight embargoes.

+If a Force Majeure situation arises, the agency/firm shall promptly notify the University in writing of such conditions and the cause thereof. Unless otherwise directed by the University in writing, the Service Provider shall continue to perform its obligations under the Contract as far as is reasonably practical, and shall seek all reasonable alternative means for performance not prevented by the Force Majeure event.

+11. Resolution of Disputes: All disagreements, disputes, difference that may arise 10

+between the Graphic Era (Deemed to be) University and the agency/firm which cannot be resolved through mutual negotiations shall be referred to an Arbitrator appointed in accordance with the provisions of relevant Indian or International Law as the case may be. The venue of the proceedings and arbitration shall be Dehradun, Uttarakhand, India.

+Jurisdiction: The obligations and liabilities arising out of this contract shall be construed in accordance with the laws of Union of India. The Court in Dehradun, Uttarakhand, India shall have the exclusive jurisdiction to try all or any of the dispute.

+However, the agency/firm shall not be liable for forfeiture of its performance security, liquidated damages or termination for default, if and to the extent that, it’s delay in performance or other failure to perform its obligations under the Contract is the result of an event of Force Majeure.

+For purposes of this Clause, "Force Majeure" means an event beyond the control of the Supplier and not involving the Supplier's fault or negligence and not foreseeable. +1. Graphic Era (Deemed to be) University, Dehradun, Uttarakhand intends to procure the equipment from the eligible, reputed and qualified firm/agency.

+Offer Validity Period: The tender offer should be valid for a minimum period of six months from the date of opening of the technical bid/tender.

+Opening of Tenders: Technical bids of the offers received with requisite EMD Declaration and hard copy of the tender document along with all certificates will be opened on the date as specified in the tender. All tenders received without EMD declaration and hard copy of the tender by the due date and time as mentioned above will be rejected. Further, if the same i.e. eligibility criteria given in the technical bid, will not comply to our tendered specifications/eligibility criteria shall be summarily rejected. The Financial Bids of the technically qualified/successful bidders i.e. who will technically qualify the tendered specifications in case of those firms that meet the technical specifications/parameters, will be considered for opening of their financial bids at a later date, which will be communicated to concerned suppliers/agencies
