The terms, in plain words.
| |
| |
| |
What you are getting
| |
Plainword Session, the iPhone app, is free. During the beta it comes through Apple's TestFlight, and later through the App Store. There is no account with us and no licence server. Plainword Desk, the Mac app, is not out yet; its terms will come with it.
| |
| |
| |
What it is, and what it is not
| |
Plainword Session records a session after your client agrees and turns it into text on your phone, marked line by line as you or your client. It does not write your note, make a diagnosis, suggest a billing code, or recommend a treatment, and it is not a medical device, a clinical decision tool, or an electronic health record. You are responsible for what goes in your chart.
| |
| |
| |
Recording and consent
| |
You are responsible for obtaining whatever consent your state and your profession require before recording a session. The app starts every recording with your spoken announcement and your client's answer. It ships with wording for Washington, California, Illinois (with a separate written consent step), and other states. Every one is a draft until counsel reviews it. Your counsel decides what applies to you.
| |
| |
| |
Your data is yours, and only yours
| |
We never receive, store, or process your clients' words or your transcripts. They live on your phone under your own passcode. Because we hold no key and no copy, we cannot recover anything from a lost phone, and we are not a business associate under HIPAA for the app's ordinary use. If you copy or share a transcript to another app, that is your act and that app's terms apply.
| |
| |
| |
The beta
| |
Beta builds can have defects, and each one stops working when TestFlight expires it. Tell us what broke in words. Never send a screenshot of a session.
| |
| |
| |
Warranty and liability
| |
The software is provided as is. We will fix defects we are told about and we publish what we have tested. We are not liable for the contents of any note you write, for any clinical decision, or for data lost with a device, beyond what the law does not let us exclude. Where a limit applies, our liability is capped at what you paid us in the past twelve months.
| |
| |
| |
Changes
| |
If these terms change, the new version is posted here with its date and shipped with the next app update. A change never lowers the privacy promises above.
| |
