Anthropic, a tech company specializing in artificial intelligence (AI), has filed a lawsuit against the US Department of Defense (DoD) to stop the Blacklisting of its AI system, which was implemented over the company's alleged restrictions of AI use. The lawsuit, filed in the US Court of Federal Claims, seeks to “overturn the unlawful DoD policy that bars Anthropic AI from federal contracts.” In its complaint, Anthropic argues that the DoD's “blacklisting” will harm the company by preventing it from participating in important government procurement offerings. This goes against the weighing of the positivity and negativity of AI systems, thereby impacting the broad use of AI technologies.

A spokesperson for the Defense Department has been quoted in several news outlets as stating that "the department will defend its policy of restricting certain technologies from federal contracting to protect the nation's security, consistent with the law."

The lawsuit also aims to overturn a rule forbidding government agencies from using specific AI technologies due to potential national security risks. The so-called "blacklist" was imposed after concerns surfaced about China potentially gaining access to sensitive technology through AI sales. In response, the Pentagon published a memorandum in February barring federal agencies from using certain restricted technologies from certain Chinese vendors.

The company's lawyers point out that the rule applies to the entire American market, not just government entities, and thus constitutes unfair competition. They argue that the rule violates fundamental principles of free trade and fair competition and should not apply to US-based companies such as Anthropic AI, which they say is not under Chinese control.
